Terms and Conditions of Use for the Split Payment Service
Article 1 (Purpose)
The purpose of these Terms and Conditions is to stipulate the rights and obligations between Travel Wallet Inc. (hereinafter referred to as the “Company”) and the customer, as well as the conditions, contents, and procedures for using the Split Payment Service, which is a supplementary (ancillary) service provided by the Travel Wallet service.
Article 2 (Definitions)
① The definitions of the terms used in these Terms and Conditions are as follows:
- “Terms and Conditions of Use for the Travel Wallet Service” refers to the terms and conditions entered into between the Company and the customer in relation to the use of the Travel Wallet service, which are posted on the homepage or app screen operated and provided by the Company, and include the Terms and Conditions of Use for Small-Amount Overseas Remittance Service, Online Currency Exchange Service, and Travel Pay Service.
- “Travel Pay Card” (hereinafter referred to as the “Card”) refers to a prepaid electronic payment method issued and managed by the Company in accordance with the Electronic Financial Transactions Act, which can be used for payments at domestic credit card merchants and overseas online and offline merchants that accept VISA cards.
- “Split Payment Service” (hereinafter referred to as the “Service”) refers to a supplementary (ancillary) service of the Travel Wallet service, where two or more members form a group, and when the representative member makes a payment using their card, a portion of the total payment amount is also paid by the other members’ cards according to the specified payment method.
- “Social Service” refers to a supplementary (ancillary) service of the Travel Wallet service that is provided separately in accordance with the Terms and Conditions of Use for the Social Service.
- “Member” refers to a customer who agrees to these Terms and Conditions and the Terms and Conditions of Use for the Travel Wallet Service, applies for and receives issuance of a Card through the mobile app provided and operated by the Company, and uses the Service.
- “Group” refers to a voluntarily formed association of two or more members for the purpose of using this Service, created through invitation by a representative or participation through a social service post.
- “Representative” refers to a member who creates a group for the purpose of using the Service and recruits other members, and is authorized to determine the payment method for the group’s total payment amount.
- “Group Member” refers to a member who indicates intent to participate in the group created by the Representative and makes payment of a portion of the group’s total payment amount according to the specified payment method.
② Any matters not defined in these Terms and Conditions shall be governed by the Terms and Conditions of Use for the Travel Wallet Service, the Terms and Conditions of Use for the Social Service, the Standard Terms and Conditions for Electronic Financial Transactions, applicable laws, and generally accepted practices.
Article 3 (Effectiveness and Amendment of the Terms and Conditions)
① These Terms and Conditions shall take effect when the Company notifies the Member by posting them on the Company’s website or app, or by delivering them at the time of card purchase or issuance, and when the Member agrees thereto.
② If the Company establishes or amends these Terms and Conditions, it shall specify the effective date and the reasons for the amendment, and notify the Member by posting them on the website or app screen starting from one month before the effective date. In the case of urgent amendments due to changes in laws or regulations, the amended Terms and Conditions shall be posted on the website or app screen for at least one month and the Member shall be notified via electronic means.
③ The Member may terminate the contract until the last business day before the effective date of the amended Terms and Conditions after the changes have been posted or notified. If the Member does not express any objections to the changes, the Member shall be deemed to have agreed to the amended Terms and Conditions.
④ If the Member does not agree to the amended Terms and Conditions, the use of all or part of the Service may be restricted.
Article 4 (Presentation, Delivery, and Explanation of the Terms and Conditions)
① The Company shall clearly present the Terms and Conditions to the Member, and if requested by the Member, shall deliver a copy of the Terms and Conditions via transmission of electronic documents (including email), fax, mail, or direct delivery.
② If the Member requests an explanation of the Terms and Conditions, the Company shall explain the key content of the Terms and Conditions to the Member using one of the following methods:
- Directly explaining the key content of the Terms and Conditions to the Member
- Displaying the key content of the Terms and Conditions in a way that is easily understandable through an electronic device, and receiving the Member’s acknowledgment of understanding through the same electronic device
Article 5 (Matters Not Stipulated in the Terms and Conditions)
① If the Company and the Member have separately agreed on matters related to this Service that differ from these Terms and Conditions, such agreement shall prevail over the provisions of these Terms and Conditions.
② Matters not stipulated in these Terms and Conditions shall be governed by the Travel Wallet Service Terms and Conditions, Social Service Terms and Conditions, and other terms and conditions posted by the Company on its website or app screen. In the event of a conflict between this Agreement and other terms and conditions, this Agreement shall prevail.
③ Matters not stipulated in this Agreement or in the relevant Travel Wallet terms shall be governed, unless otherwise agreed, by the Framework Terms and Conditions on Electronic Financial Transactions, the Act on Electronic Financial Transactions, other applicable laws, and general practices.
Article 6 (Roles and Obligations of Members)
① The “Representative” shall perform the roles and bear the rights and obligations set forth in the following subparagraphs with respect to this Service:
- Creating a group for the use of this Service within the Company’s mobile app
- Recruiting Members to participate in the group by directly inviting them or posting on the Social Service board
- Managing the group member list by deleting or editing participants
- Selecting the payment method for the total payment amount arising from the group
- Paying the total payment amount arising from the group with the Representative’s own card
② The “Group Member” shall perform the roles and bear the rights and obligations set forth in the following subparagraphs with respect to this Service:
- Participating in a group for this Service by accepting the Representative’s invitation or joining through a social board post
- When the Representative directly enters the individual payment amount for a group member, confirming or rejecting the entered amount upon request
- Paying part of the total payment amount arising from the group based on the predetermined payment method
③ Both the Representative and Group Members may withdraw from the group at any time based on their own will. However, the Representative may expel a group member based on their reasonable judgment. If the Representative withdraws, the group shall be automatically disbanded (terminated).
Article 7 (Payment Method, etc.)
① In the event that a payment amount arises in connection with a group within this Service, the entire payment amount of the group shall be paid in Korean won or foreign currency using one of the following payment methods:
- Equal Split (1/N) Payment Method: The entire payment amount of the group shall be equally divided by the total number of members including the representative and group members, and each member’s share shall be withdrawn from their respective card, thereby completing the payment.
- Direct Input Payment Method: The representative directly inputs the payable amount for each group member out of the total group payment amount, and upon requesting confirmation of the input amount from each group member and receiving confirmation, the specified amount shall be withdrawn from each member’s respective card. Provided, however, if any group member does not confirm or rejects the input amount within 5 minutes from the time of receiving the confirmation request, the payment method shall automatically switch to the payment method set forth in subparagraph 1 of this paragraph.
② The representative may make payments using this Service as prescribed in the following subparagraphs:
- The representative may pre-set or cancel any of the payment methods set forth in paragraph 1. Provided, however, if such setting is canceled, payments via this Service may fail or be restricted.
- If the representative selects the payment method described in paragraph 1, subparagraph 2, the representative must request confirmation of the directly input amounts from each group member respectively for their payment.
- The representative must pay the entire group payment amount using a Travel Pay Card in their possession; if payment is attempted using any other method, the payment via this Service may fail or be restricted.
- Any remaining balance (difference) of the total group payment amount not paid by the group members shall be regarded as the amount payable by the representative.
- When the representative pays the entire group payment amount using the Travel Pay Card in their possession, the actual payment is made by withdrawing the payable amount from each of the Travel Pay Cards held by the representative and group members, and the relevant payment details are notified to each member via mobile app push notifications.
③ The payment amount withdrawn from the Travel Pay Card held by the representative and group members must be equal to or greater than the minimum recharge amount per currency specified in the Travel Pay Terms of Use and must not exceed the maximum recharge amount per card as stipulated in accordance with the Electronic Financial Transactions Act and the Travel Pay Terms of Use.
Article 8 (Causes of Payment Failure)
Payment via this Service may fail or be restricted if any of the following events occur:
- If the representative does not set or cancels the payment method set forth in Article 8, paragraph 1.
- If the representative attempts to make payment using a payment method other than the Travel Pay Card held by themself.
- If the balance of the Travel Pay Card held by the representative or any group member is insufficient to cover their respective share of the payment amount.
- If the respective share of the payment amount of the representative or any group member is less than the minimum recharge unit amount per currency.
- If the respective share of the payment amount of the representative or any group member exceeds the maximum recharge amount per Travel Pay Card.
- If any other circumstance arises in which payment via this Service is deemed significantly difficult or impossible.
Article 9 (Payment Cancellation and Refund)
① In the event that a cause for payment failure under Article 8 occurs or if a request for payment cancellation and refund is made by the representative, etc., refunds shall be made to the participating representative and group members in the same method, amount, and individual currency used for the payment, in accordance with the following:
- In the case of the Equal Split (1/N) payment method, the representative and group members who participated in the relevant payment shall be refunded their evenly split amounts in the same method and individual currency in which the payment was made.
- In the case of the Direct Input payment method, the representative and group members who participated in the relevant payment shall be refunded the individual payment amounts input by the representative and confirmed by each group member, in the same method and individual currency in which the payment was made.
② Refunds under this Article shall not be affected by whether the group continues to exist or is dissolved (terminated).
Article 10 (Precautions for Use)
① The minimum payment amount per user of this Service is the same as the minimum recharge amount of the Travel Pay Card, and the maximum payment amount is the same as the maximum recharge amount of the Travel Pay Card.
② The balance of recharged funds in the cards held by the representative and all group members must each be equal to or exceed the respective payment amounts for a normal payment to be processed via this Service.
③ To use this Service, the representative must be issued a physical Travel Pay Card, whereas other group members may use the Service with a mobile card even if they do not possess a physical card.
④ This Service has no direct relation to other supplementary (ancillary) services of the Travel Wallet Service, and in particular, its use in conjunction with the auto-recharge service may be restricted.
⑤ This Service is, in principle, provided for payment items primarily used by members while traveling, such as restaurants, cafés, bars, supermarkets, convenience stores, public transportation, etc., at domestic or overseas affiliated merchants. However, payment via this Service may fail or be restricted for items such as ATM withdrawals, lodging, flights, fuel, rental cars, and tax refunds.
⑥ For other matters not stipulated in this Agreement that require the definition of specific terms of use for this Service, the company may establish or revise internal policies and manuals after prior notice to the members.
Article 11 (Company’s Role and Obligations)
The Company shall perform the roles specified in the following subparagraphs in relation to this Service and bear the associated obligations:
- The Company shall make every effort to provide continuous and stable Service to the members, except in the case of special circumstances such as regular maintenance.
- The Company may, at its discretion, monitor whether members are using this Service in a manner deemed appropriate.
- The Company may post information, advertisements, etc., deemed appropriate or potentially useful within this Service.
- The Company shall promptly notify the members of any changes in the terms and conditions of use, internal policies, or manuals related to the provision of this Service.
Article 12 (Restriction and Suspension of Use)
The Company may restrict or suspend a member’s use of this Service and, after taking necessary action, promptly notify the member if any of the following apply:
- If the member uses this Service with an account not registered under their real name.
- If the group created in connection with this Service is used for the posting of obscene materials, defamation, infringement of rights, or for unlawful purposes that harm public morals.
- If the group created in connection with this Service is used directly or indirectly for advertisements or other commercial purposes without prior written consent from the Company.
- If the use of this Service is reasonably judged to be inconsistent with the purpose of the Service.
Article 13 (Disclaimer)
Except as otherwise provided in these Terms and Conditions, the Company does not hold any direct or indirect representation with respect to the use of this Service, and shall not be liable for any damages or losses incurred by members in connection with their use of this Service, unless the Company’s willful misconduct or gross negligence is involved.
